These Terms of Service govern access to and purchases from smartecco.shop. In these terms, "smartecco," "we," "us," and "our" refer to the operator of the smartecco online store. By using the website or submitting an order, the user agrees to these terms and the policies linked on the website.
Online store and eligibility
smartecco sells electronics, home appliances, accessories, and related products through its online store. A customer must be legally able to enter a purchase contract and provide accurate account, billing, payment, and delivery information. The website may not be used for unlawful, fraudulent, abusive, or unauthorized activity.
Product information
We try to keep descriptions, specifications, images, condition, compatibility, included accessories, prices, and availability accurate. Screen settings, manufacturer updates, packaging changes, and production batches may cause minor differences. Customers should review the product page and confirm important measurements, voltage, installation, compatibility, and requirements before ordering. We may correct errors and update information.
Brands and affiliations
Third-party brand names, trademarks, product images, and model references belong to their respective owners and are used to identify products. Their appearance does not by itself mean that smartecco is sponsored, endorsed, or an authorized representative. We will state an official relationship clearly when one applies.
Orders and acceptance
An order is an offer to purchase. An automated confirmation acknowledges receipt but does not guarantee acceptance or shipment. We may accept, reject, limit, verify, or cancel an order for legitimate reasons, including unavailable inventory, a material pricing or product error, payment failure, an unserviceable address, quantity limits, suspected fraud, or legal restrictions. If we cancel after collecting payment, we will refund the canceled amount.
Prices, taxes, and payment
Prices are in U.S. dollars unless clearly stated otherwise. The checkout shows the product total, discounts, applicable tax, and final amount before payment. Standard shipping on U.S. orders is free. Payment is subject to the Payment Policy and the terms of the selected payment provider.
Shipping and delivery
Processing and delivery estimates, tracking, address responsibilities, freight delivery, delay information, and shipping limits are stated in the Shipping Policy. Delivery estimates are not guarantees. Risk of loss and title transfer as provided by applicable law and the carrier's delivery record; this does not remove any non-waivable consumer right.
Returns, refunds, cancellations, and warranties
The Return and Refund Policy explains the 30-day return window, eligibility, return costs, and refund timing. The Order Cancellation and Changes Policy explains when an order may be stopped or changed. Product and manufacturer warranty information is governed by the Warranty Policy and any specific written warranty supplied with the product.
Acceptable use
Users must not interfere with the website, bypass security, introduce malicious code, scrape or copy content in violation of law, use false information, attempt unauthorized transactions, infringe intellectual property, harass others, or use the store to violate any law. We may suspend access or cancel orders connected to prohibited activity.
Intellectual property
The website's original text, layout, graphics, logos, and other smartecco content are owned by or licensed to smartecco and are protected by applicable law. Limited personal use of the website does not transfer ownership. Third-party trademarks and content remain the property of their owners.
Third-party services and links
Payment providers, carriers, manufacturers, installers, warranty providers, and linked websites may provide separate services under their own terms. smartecco is not responsible for an independent third party's website or acts outside our control, but we remain responsible for obligations that applicable law places on us as the seller.
Disclaimer and limitation of liability
To the fullest extent permitted by law, the website is provided on an "as available" basis and implied warranties are limited only as legally permitted. Nothing in these terms excludes liability or consumer rights that cannot be excluded. To the fullest extent permitted by law, smartecco is not liable for indirect, incidental, special, or consequential loss arising from use of the website or products. Any limitation applies only to the extent enforceable under applicable law.
Indemnification
To the extent permitted by law, a user agrees to indemnify smartecco against third-party claims arising from that user's unlawful use of the website, fraud, infringement, or material violation of these terms. This section does not apply where prohibited by law.
Governing law and disputes
These terms are governed by the laws of South Carolina and applicable United States federal law, without limiting mandatory consumer protections that apply where the customer lives. Before starting a formal claim, please contact us so we can try to resolve the issue.
Changes and severability
We may update these terms by posting a revised version and date. The version in effect when an order is placed governs that order unless law requires otherwise. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law.
